Welcome to Chérie.

These Terms and Conditions govern your access to and use of the Chérie website, including any purchase made through the website.

Please read these Terms carefully before using our website or placing an order. By accessing the website, submitting an order or purchasing a product from Chérie, you confirm that you have read, understood and agreed to these Terms.

If you do not agree to these Terms, you should not use the website or purchase our products.

 


 

1. About Chérie

Chérie Mag ("Chérie," "we," "us," or "our") is an independent publication and creative brand operated from Vietnam. We sell digital products and physical publications to customers worldwide through our online store at cheriemag.com (the "Site"), powered by Shopify.

By accessing our Site or placing an order, you agree to be bound by these Terms and Conditions. Please read them carefully before purchasing.

2. Products offered by Chérie

Chérie offers digital magazine templates, physical editorial magazines and other digital or physical products that may be introduced from time to time.

Each product page will explain what the customer will receive, whether the product is digital or physical, its principal features, the relevant price, any required software or third-party platform and any product-specific conditions.

A digital magazine template and a physical Chérie magazine are different products. Customers should carefully review the product description before placing an order.

3. Online Store Terms

By agreeing to these Terms, you confirm that you are at least 18 years old or have reached the age of legal majority in your country or place of residence. If you have not reached the applicable age of legal majority, a parent or legal guardian must place the order and accept these Terms on your behalf.

You may not use our products, website or services for any illegal, unauthorised, fraudulent or harmful purpose. You must not use Chérie products in a way that violates copyright, trademark, privacy, consumer-protection or other applicable laws.

You must not transmit viruses, malicious code, harmful software or any material designed to interfere with the security or operation of the website.

You must provide accurate, current and complete information when using the website or placing an order. You confirm that you are authorised to use the email address, billing information and payment method submitted during checkout.

A breach of these Terms may result in the suspension or termination of your access to the website, digital products or related services. This does not affect any rights or obligations that arose before the suspension or termination.

4. General Conditions

We reserve the right to refuse service, decline an order or restrict access to the website where reasonably necessary and permitted by law. This may occur where we suspect fraud, misuse, unlawful activity, a security risk, infringement of intellectual-property rights or a material breach of these Terms.

We will not refuse or cancel an accepted consumer order solely for the purpose of charging a higher price or avoiding a legal obligation.

The website, its content and the products available through it are provided subject to these Terms and any separate policies that apply to a particular transaction.

Your use of the website does not grant you ownership of any Chérie content, digital template, design, layout, brand element or intellectual property. Any permitted use of a digital magazine template is governed by the separate Digital Product Licence and Usage Policy.

You agree not to reproduce, duplicate, copy, sell, resell, distribute or commercially exploit any part of the website, its content or Chérie’s products except where expressly permitted in writing or under the applicable licence.

Information submitted through the website may be transferred through third-party systems involved in operating the store, processing orders, sending emails or delivering products. Personal information and payment information will be handled in accordance with the applicable Privacy Policy and Payment Policy.

Section headings are included for convenience and readability. They do not limit or otherwise affect the meaning of these Terms.

5. Digital magazine templates

Chérie digital magazine templates are editable digital products designed to help customers create personalised magazines using Canva or another editing platform identified on the product page.

When you purchase a digital magazine template, you are purchasing access to a digital template. You will not receive a printed magazine or any physical product through the post.

Unless a separate customisation service is expressly included in the product description, Chérie does not edit or personalise the template for you. You are responsible for adding your own photographs, written content, names, dates and other personal material.

You are also responsible for reviewing the completed design, exporting the file and arranging and paying for any printing you choose to undertake.

Your right to use the template is governed by the separate Digital Product Licence and Usage Policy.

Refunds on digital products are not available as a general rule given the nature of digital goods. However, in accordance with the Law on Protection of Consumers' Rights (Law No. 19/2023/QH15), if a digital product is defective, inaccessible, or materially different from its description on the product page, you retain the right to request a remedy. This may include a replacement template link, a corrected file, or a refund where the product cannot reasonably be made to conform to its description. Refunds will not be issued where the product has been accessed and used as described, and the issue results solely from your own editing choices, export settings, or use of an incompatible third-party platform. If you believe a digital product you received does not match what was described, please contact us at support@cheriemag.com within 7 days of delivery.

6. Digital template delivery

After your order for a digital magazine template has been successfully completed, the template will normally be delivered to the email address provided during checkout.

The email may contain a button or link that redirects you to the Canva template or to another page through which the template can be accessed.

You are responsible for entering a valid and accessible email address, checking that it is spelled correctly and reviewing your inbox, spam, junk and promotions folders.

If you do not receive the delivery email within the timeframe stated on the website, you should contact us at support@cheriemag.com. Please provide your name, order number, the email address used at checkout and the name of the template purchased.

We may ask you to verify information connected to the order before resending or replacing a template link.

A digital product is generally considered delivered when the access email or template link has been sent to the email address provided during checkout. This does not affect any right you may have if the link is defective, inaccessible or does not provide the product you purchased.

7. Canva and other third-party platforms

Certain Chérie digital products are designed to be accessed and edited through Canva. You may need to create or sign in to a Canva account before using the template, and depending on the elements included, some features may require Canva Free, Canva Pro, or another Canva subscription tier. The product page will note any important access requirements known to us at the time of purchase.

Canva is an independent third-party platform. Chérie does not own, operate, or control Canva and is not responsible for Canva account registration, service interruptions, platform outages, account restrictions, subscription price changes, or independent changes to features, fonts, graphics, or platform elements. You are responsible for complying with Canva's own terms and licensing requirements when using the platform.

If a Chérie-provided template link is defective or does not provide access to the product you purchased, please contact us at support@cheriemag.com so that we can investigate and provide an appropriate solution.

8. Third-Party Images and Visual Content

Chérie's website, digital templates, physical magazines, and promotional materials may include photographs, illustrations, or other visual content created by third parties. Where Chérie uses third-party visual content, we aim to do so only where we have obtained an appropriate licence, received permission from the copyright owner, or otherwise established a lawful basis for its use. Copyright and other intellectual property rights in third-party works remain with their respective creators, photographers, or rights holders.

A reference to Pinterest or another visual discovery platform indicates only where content may have been found. It does not mean that Pinterest owns, licenses, or approves the image for our use. We do not claim ownership of visual works belonging to third parties, and purchasing a Chérie product does not grant you a separate right to reproduce, extract, or commercially use any third-party image appearing within it.

Images included inside an editable digital template may be provided as layout references only and may need to be replaced before you export, publish, or print your completed magazine. The relevant product page or Digital Product Licence and Usage Policy will confirm whether a particular image may remain in your final project. You remain responsible for ensuring that all photographs, artwork, and other content you personally add to a template are owned by you, properly licensed, or used with the necessary permission.

If you are a copyright owner and believe your work has been used without appropriate permission, please contact us at support@cheriemag.com with details of the relevant work, where it appears, and evidence of your rights. We will review the matter in good faith and take appropriate action where necessary

9. Privacy and Data

We collect and process your personal data in accordance with our Privacy Policy, which forms part of these Terms and Conditions and is available at [link to Privacy Policy].

In accordance with Decree No. 13/2023/ND-CP on Personal Data Protection and the Law on Personal Data Protection effective January 1, 2026, we wish to inform you of the following:

We collect personal data including your name, email address, delivery address, and payment information for the purposes of processing your order, delivering your product, communicating with you about your purchase, and improving our services.

Your personal data may be shared with third-party service providers acting on our behalf, including Shopify (ecommerce platform), PayPal (payment processing), our third-party logistics provider (order fulfilment and shipping), and email delivery providers. These parties are permitted to process your data only for the purpose of fulfilling their service to us and are not permitted to use it for any other purpose.

If you are based outside Vietnam, your personal data may be transferred internationally in connection with the delivery of your order or the processing of your payment. Where such transfers occur, we take reasonable steps to ensure your data is handled in a manner consistent with applicable law.

As a data subject, you have the right to know what personal data we hold about you, to access and correct that data, to withdraw your consent to processing, to request deletion of your data, to restrict or object to certain processing, and to lodge a complaint with a competent authority. To exercise any of these rights, please contact us at support@cheriemag.com. We will respond within 72 hours of receiving your request.

We do not sell your personal data to third parties. We retain your data only for as long as reasonably necessary to fulfil your order, comply with our legal obligations, and resolve any disputes.

By placing an order and using our Site, you consent to the collection and processing of your personal data as described in this section and in our Privacy Policy.

10. Physical magazines

A physical Chérie magazine is a printed editorial publication created and sold by Chérie. A physical magazine is separate from Chérie’s editable digital magazine templates.

Where a product is physical, this will be clearly stated on the relevant product page.

Information concerning shipping, delivery, international orders, damaged parcels and delivery delays is provided in the separate Shipping and Delivery Policy.

Information concerning returns, refunds and cancellations is provided in the separate Refund and Cancellation Policy.

11. Placing an order

To place an order, you must follow the checkout instructions displayed on the website.

Before submitting your order, you are responsible for reviewing the selected product, product format, quantity, price, email address, billing information, delivery address for any physical product, discount code and total amount payable.

You will have an opportunity to review and correct your information before submitting the order.

By submitting an order, you are making an offer to purchase the selected product in accordance with these Terms and the policies that apply to that product.

After submitting an order, you may receive an automated acknowledgement email. This confirms that we received your order but does not necessarily mean that the order has been accepted.

An order is accepted when we send an order confirmation, provide access to the digital product, begin supplying the purchased product or dispatch a physical product, depending on which occurs first and which is relevant to the order.

12. Accuracy of order information

You must provide accurate, current and complete information when placing an order.

Chérie is not responsible for a delay or inability to deliver a digital product that results solely from an incorrect email address provided by the customer.

Chérie is not responsible for a delivery problem involving a physical product that results solely from an incomplete or incorrect delivery address, subject to the Shipping and Delivery Policy and applicable law.

You should contact us as soon as possible if you discover an error in your order information.

We cannot guarantee that information can be changed after a digital product has been delivered, fulfilment has begun, a physical product has been dispatched, a personalised product has entered production or another clearly stated modification deadline has passed.

13. Order acceptance, refusal and cancellation by Chérie

We may decline or cancel an order before fulfilment where reasonably necessary.

This may occur if the product is unavailable or discontinued, if there is an obvious pricing or description error, if required order information is missing, if we cannot verify the order, if the transaction appears fraudulent or unauthorised, if a promotion has been materially misused, if the order violates these Terms, if fulfilment would violate applicable law or if circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after receiving payment, the payment will be handled in accordance with the Payment Policy and Refund and Cancellation Policy.

We will not cancel an accepted consumer order solely for the purpose of charging a higher price.

14.  Modifications to the Service and Prices

Prices for Chérie products may change at any time without prior notice. A price change will not normally affect an order that has already been accepted.

The price applicable to your order will be the price displayed during checkout at the time the order is submitted, subject to the provisions concerning obvious pricing errors in these Terms.

We may modify, update, suspend or discontinue any product, feature, website function or service where reasonably necessary.

This may include changing a product’s availability, format, design, page count, compatibility, delivery method or supporting platform. Any material product feature will be clearly described on the relevant product page before purchase.

We may also introduce, withdraw or modify discounts, promotional offers and product collections. Changes to a promotion will not normally affect an order that has already been accepted.

We are not responsible for changes independently made by third-party platforms, including Canva, Shopify, payment processors, email providers or other external services. This may include changes to platform features, subscription prices, fonts, graphics, accounts or technical requirements.

Where a change made by Chérie materially affects an accepted order, we will contact the customer and provide any remedy required by the Refund and Cancellation Policy or applicable consumer law.

We may temporarily suspend access to the website or part of the service for maintenance, updates, security, technical issues, legal compliance or circumstances outside our reasonable control.

Nothing in this section gives Chérie the right to unfairly change the essential terms of an accepted consumer order without the customer’s agreement.

15. Customer-provided content

When editing a template, you may add your own photographs, names, dates, messages, stories, quotations, artwork, logos and other material.

You retain ownership of original content that you create and add to the template.

You are responsible for ensuring that you have the legal right and any required permission to use all content you add.

You must not use a Chérie product to create, upload, print or distribute material that infringes copyright, trademark, privacy, publicity or other legal rights.

You must also not use a Chérie product to distribute unlawful, fraudulent, threatening, defamatory, abusive or harmful material.

You are responsible for obtaining appropriate permission before using photographs, personal information, quotations or creative works belonging to another person.

Chérie is not responsible for claims arising solely from content that you added without the required rights, consent or permission.

16. Intellectual property belonging to Chérie

Unless otherwise stated, all intellectual property displayed on or made available through the website belongs to Chérie or has been lawfully licensed to Chérie.

This includes the Chérie and Chérie Mag names, logos, product names, digital templates, page layouts, illustrations, graphics, written content, articles, photographs, videos, website text, website design, downloadable files, packaging designs and promotional materials.

You may not copy, reproduce, republish, sell, distribute, modify, imitate, license, publicly display or commercially exploit Chérie materials without prior written permission, except to the extent expressly permitted under the applicable Digital Product Licence and Usage Policy.

Nothing on the website grants you ownership of or a general right to use Chérie’s name, logo or brand identity.

17. Acceptable use of the website

You may use the website only for lawful personal shopping and informational purposes.

You must not interfere with the operation or security of the website, attempt to gain unauthorised access to an account or server, introduce viruses or harmful code, scrape or extract website content without permission, submit fraudulent orders, use false or stolen information, impersonate another person or use the website to infringe another person’s rights.

You must not reproduce or commercially exploit the website without prior written permission.

We may restrict or suspend website access where reasonably necessary to protect our customers, systems, intellectual property or legal rights.

18. Termination

These Terms remain in effect while you access the website, maintain a customer account or use a Chérie product.

You may stop using the website at any time. Ending your use of the website does not automatically cancel an order, produce a refund or terminate obligations arising from a product that has already been purchased. Refunds and order cancellations are governed by the separate Refund and Cancellation Policy.

Chérie may restrict, suspend or terminate your access to the website, customer account, template link or related service where we reasonably believe that you have materially breached these Terms, violated the Digital Product Licence and Usage Policy, engaged in fraud, threatened the security of the website, infringed intellectual-property rights or used a product for an unlawful purpose.

Where the breach can reasonably be corrected, Chérie may provide notice and an opportunity to correct it before terminating access. Immediate suspension or termination may occur where reasonably necessary to prevent fraud, security harm, unlawful activity, unauthorised distribution or continuing infringement.

Termination of access does not transfer ownership of any Chérie intellectual property to you and does not authorise continued use of a product in violation of its licence.

The provisions concerning intellectual property, customer-provided content, limitation of liability, indemnification, dispute resolution and any payment or legal obligation that arose before termination will continue to apply after termination where appropriate.

Termination will not affect any mandatory consumer rights or remedies that accrued before the termination date.

19. Reviews and testimonials

You may be invited to submit a review, rating, photograph or testimonial.

Any review you submit must reflect your honest experience and must be accurate to the best of your knowledge.

Reviews must not contain unlawful, abusive, fraudulent or irrelevant material and must not disclose another person’s private information without permission.

If you received a discount, gift or other incentive in connection with a review, you are responsible for disclosing that relationship where required by law.

By intentionally submitting content for publication, you grant Chérie permission to reproduce, format and display that content for the purpose for which it was submitted.

We may remove content that is fraudulent, unlawful, abusive, irrelevant or in violation of these Terms. We will not remove a genuine review merely because it expresses a negative opinion.

Private photographs, messages or customer stories will not be used in advertising solely because they were provided in connection with an order. Separate permission will be obtained where required.

20. Third-party services and links

The website may contain links to or use services provided by third parties, including Shopify, Canva, payment providers, email-delivery providers, analytics services, social media platforms, printing providers and delivery providers.

Third-party websites and services are governed by their own terms and privacy practices.

A link to a third party does not necessarily mean that Chérie controls, sponsors or endorses that third party.

We are not responsible for independent third-party websites or services that are outside our reasonable control.

This does not remove any responsibility Chérie has under applicable law for fulfilling an accepted order or for service providers acting on Chérie’s behalf.

21. Website availability

We aim to keep the website accessible and functioning correctly, but continuous or error-free access cannot be guaranteed.

We may temporarily suspend or restrict the website for maintenance, updates, security measures, technical problems, platform outages, legal compliance or circumstances outside our reasonable control.

We may correct typographical errors, broken links, outdated information, inaccurate descriptions and technical issues.

Any correction that materially affects an accepted order will be handled fairly and in accordance with applicable consumer law.

22. Editorial and informational content

Chérie may publish editorial content concerning personal development, emotional wellbeing, relationships, culture, beauty, lifestyle, creativity, health, finance and other areas of general interest.

This content is provided for general editorial, educational and informational purposes.

Unless expressly stated otherwise, it is not personalised medical, psychological, financial, legal, nutritional or other professional advice.

You should seek advice from an appropriately qualified professional when your individual circumstances require it.

The views expressed by an individual contributor may be their own and do not necessarily represent every view held by Chérie.

23. Our Responsibility and Liability

Chérie is responsible for providing products that materially conform to their descriptions and for performing its obligations with reasonable care. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, or any other liability that cannot legally be excluded under applicable Vietnamese law or the mandatory consumer laws of your country of residence.

The Chérie website and its general content are provided on an "as available" basis. We make reasonable efforts to ensure that product descriptions, template previews, and website information are accurate, but we do not guarantee that every colour, photograph, or preview will appear exactly the same on every device or in every printed result. We also do not guarantee that access to the website will always be uninterrupted or free from technical errors.

To the fullest extent permitted by applicable law, Chérie will not be responsible for indirect, incidental, or consequential loss that was not reasonably foreseeable when

the contract was formed. This includes loss or damage caused solely by inaccurate information supplied by you, your failure to follow clearly provided instructions, unauthorised use or sharing of a digital template, content you added without the necessary rights or permissions, errors in a completed design that you approved before printing, or acts and omissions of an independent printing provider or third-party platform such as Canva, Shopify, or a payment provider that are outside our reasonable control.

Where Chérie is legally responsible for a loss arising from a consumer purchase, our total liability relating to a particular order will not exceed the amount paid for the product giving rise to the claim. This financial limit does not apply where imposing it would violate mandatory consumer law.

Nothing in this section reduces any statutory remedy available to you as a consumer.

24. Indemnification

To the extent permitted by applicable law, you agree to compensate Chérie for reasonable losses, liabilities, damages, costs and expenses resulting directly from your unlawful use of the website or products, your material breach of these Terms or your infringement of another person’s intellectual-property, privacy or other legal rights.

This may apply where a claim results from photographs, written material, artwork, logos, personal information or other content that you added to a template without the necessary ownership, licence, consent or permission.

This may also apply where you unlawfully reproduce, resell, distribute, share or commercially exploit a Chérie template or Canva access link in violation of the Digital Product Licence and Usage Policy.

Chérie will notify you within a reasonable period after becoming aware of a relevant third-party claim and will take reasonable steps to avoid unnecessary loss.

You will not be responsible under this section to the extent that a claim or loss was caused by Chérie’s own unlawful conduct, negligence, breach of contract or infringement.

This section is not intended to impose liability on a consumer where doing so would be unfair, disproportionate or prohibited by applicable consumer law.

25. Complaints and customer support

Questions or complaints may be submitted to support@cheriemag.com.

When contacting us about an order, please provide your full name, order number, email address used at checkout, the product purchased and a clear explanation of the issue.

Screenshots or photographs may be requested where reasonably necessary to investigate the matter.

We aim to respond to ordinary customer-support requests within 3-5 business days.

26. Governing law

These Terms and transactions entered into with Chérie are governed by the laws of the Socialist Republic of Vietnam, including the Law on Protection of Consumers' Rights (Law No. 19/2023/QH15), Decree No. 52/2013/ND-CP on e-commerce as amended by Decree No. 85/2021/ND-CP, and other applicable Vietnamese law.

If you have a complaint or dispute arising from a transaction with Chérie, we encourage you to contact us first at support@cheriemag.com so that we may work toward a resolution in good faith. We aim to respond to all complaints within 3 to 5 business days.

If we are unable to resolve your complaint directly, Vietnamese consumers may escalate their dispute to the Vietnam Competition and Consumer Authority (VCCA) under the Ministry of Industry and Trade, or to another competent consumer protection authority. Information about the VCCA is available at bvntd.gov.vn.

Subject to mandatory consumer rights that cannot be excluded by contract, unresolved disputes will be submitted to a competent court in Vietnam.

If you are a consumer living outside Vietnam, you may also retain mandatory consumer protections provided by the laws of your country of residence where those protections cannot legally be excluded by agreement.

27. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to our products, website, business operations, security requirements or applicable law.

The updated version will be published on the website with a revised “Last updated” date.

Changes will generally apply to website use and orders placed after the updated Terms take effect.

The version in effect when you placed an order will continue to apply to that order unless a change is required by law, you expressly agree to the change or the change benefits you without reducing an existing right.

28. General

You may not transfer your order, digital product access, or contractual rights to another person except where these Terms, the applicable licence, or mandatory law permits it. Chérie may transfer its rights or obligations as part of a lawful business transfer or reorganisation, provided that the transfer does not reduce your mandatory consumer rights.

If any provision of these Terms is found by a competent authority to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with the relevant product page, your order confirmation, the Privacy Policy, Payment Policy, Refund and Cancellation Policy, Shipping and Delivery Policy, Digital Product Licence and Usage Policy, and any product-specific policy disclosed before purchase, form the entire agreement between you and Chérie concerning your order.
